California Labor Dept Org Chart
Ever wonder where all the various California labor agencies fit in? I’m talking about the Department of Industrial Relations, the Division of Labor Standards Enforcement, the Labor and Workforce Development Agency, the Labor Commissioner, CAL/OSHA, and on and on. No? Well, you just might if you ever need to bring an employment or labor law lawsuit. And whoever you retain as your lawyer had better.

Can an employer hire someone to take your place before
given notice of termination?

That question is nearly impossible to answer because the answer depends on so much more information. California is an at-will state, meaning, employers can fire or demote employees whenever, however they wish, for whatever reason they wish AS LONG AS IT’S NOT AN ILLEGAL REASON. Illegal reasons include: discrimination (disability, racial, sex orientation, marital, etc.), during a protected CFRA or FMLA medical leave, retaliation (for whistleblowing, taking medical leave, etc.), and on and on. If facts establish an illegal reason for the termination, you may have a claim. Speak to an attorney right away.
